What I propose is to explicit the relationship between two dimensions, which, in my opinion, are inseparable from any discourse about vulnerability. On the one hand, the horizon of politics and institutions, the horizon of practice; on the other, that relative to the definition of the ‘humanity of the human’, the theoretical horizon. To talk about the ‘politics of vulnerability’, we need to understand what is meant by vulnerability and the dimensions it implies. In this particular case, I want to (...) discuss two philosophers who found a way to keep these two dimensions together, namely, Judith ButlerButler, Judithand Simone WeilWeil, Simone. The thesis I would like to arrive at could be articulated in the following points: (1) vulnerability is ‘constitutive’ of the humanity of the human; (2) vulnerability also stems from certain discourses of power; (3) to accept vulnerability as the common trait of humanity can be the basis upon which to construct a nonviolent or least violent possible coexistence; (4) in order to arrive at this, the philosophical and political problems to be addressed are ‘attention for’ and ‘recognition’ of vulnerability, and this implies circumstances where vulnerability is not obvious or is not recognised as such. Plagiarism and other transgressions of the norms of academic integrity appear to be a persistent problem among upper secondary students. Numerous surveys have revealed high levels of infringement of what appear to be clearly stated rules. Less attention has been given to students’ understanding of academic integrity, and to the potential misconceptions and false beliefs that may make it difficult for them to comply with existing rules and handle complex real-life situations.In this paper we report findings from a survey of (...) European upper secondary students’ views on issues relating to academic integrity. We relate these findings to the students’ training about academic integrity, self-reported level of questionable behavior and country of study.A total of 1654 students at 51 institutions located in 6 European countries participated in the study. The participants generally believed they had a good understanding of the rules applying to them and knew how to behave in compliance with norms of academic integrity. The results indicate, however, that often, in practice, this belief was mistaken. Many students had an inadequate understanding of core elements of academic integrity. They were uncertain about how to act, and they struggled in the handling of complex situations that require context-sensitive judgement. While some differences between countries were identified, they were modest and exhibited no clear pattern. Our results also suggest that reducing students’ level of uncertainty and, to a lesser degree, improving their level of knowledge could lead them to engage less in certain types of questionable behaviours. Surprisingly, the effect of academic training is modest and ambiguous. The study also confirms that perception of peer behaviour has the strongest association with student engagement in questionable behaviours. Thus, academic integrity at the upper secondary level cannot be explained simply in terms of individual ethics or knowledge. (shrink)

This essay collects four decades of my own reflections, as an anthropologist and feminist, on gender and coloniality across various contexts in Latin America. It also highlights the decolonial methodology and vocabulary that I have had to develop in my various roles as scholar, public intellectual, and expert witness over the years. Briefly, what I present here is a decolonial feminist perspective that argues for the existence of a patriarchal political order in communal societies before colonization. Yet, in my view, (...) precolonial gender has a dual structure that is plural in essence and differs markedly from the binary gender structure of colonial-modern societies, which works in terms of a One and its marginalized others. As I argue, the capturing and transformation of precolonial dual gender structures by the modern gender system exacerbates inequality, increases violence against women, and disempowers them politically. For that reason, I speak of “low-intensity” and “high-intensity” patriarchal systems. (shrink)

In this paper, I consider the claim that a corporation cannot be held to be morally responsible unless it is a person. First, I argue that this claim is ambigious. Person flags three different but related notions: metaphysical person, moral agent, moral person. I argue that, though one can make the claim that corporates are metaphysical persons, this claim is only marginally relevant to the question of corporate moral responsibility. The central question which must be answered in discussions of corporate (...) moral responsibility is whether corporations are moral agents or moral persons. I argue that, though we can make a case for saying corporations are moral agents, they are not moral persons, and hence, we can hold them responsible. In addition, we need not treat them the way we would be obligated to treat a moral person; we needn't have the same scruples about holding a corporation morally responsible as we would a moral person. I have become curious about reciprocity within clinical practice. A vast topic that mobilizes considerations of money, knowledge, kinship, power, culture, and uses of the body, reciprocity is a strong means by which to achieve the egality required of just health care. Within health care, reciprocity might enable not only so‐called shared decision‐making and patient autonomy. It might open the door to mutual acknowledgement of the value of each participant's beliefs and habits. It might appear as a humble realization that (...) no one understands what health is and a concurrent welcoming curiosity about one another's conception of how the body and speech and mind work. From the intimate to the international levels of care, such forms of reciprocity may culminate in the radical and powerful state of reciprocal recognition.In this short essay, I will focus on one aspect of reciprocity in health care: the narrative and potentially reciprocal nature of attention in health care. A critical element in the development of therapeutic alliance, clinical accuracy, and effective practice, attention requires a donation of the self as a vessel into which can enter that which is perceived or, from the other side, a penetrating of that which is perceived so that one sees it from within its own vessel. Goal setting is an important professional method and one of the key concepts that structure a practical field such as physical rehabilitation. However, the actual use of goals in rehabilitation practice is much less straightforward than the general acceptance of the method suggests as goals are frequently unattained, modified or contested. In this paper, I will argue that the difficulties of goal setting in day-to-day medical practice can be understood by unravelling the normative assumptions of goal setting, in this case (...) three different tensions that come along with it. First, goals are developed for a future state that may require activities that clash with necessities of the present situation. Second, professionals in clinical rehabilitation centres elaborate goals for an environment that differs in terms of spatial and social characteristics from the environment in the centre, where people train for the accomplishment of goals. Finally, goal setting requires active patient participation and individual control that sometimes appears impossible, unrealistic, and undesirable. I will describe how professionals deal with these tensions in a creative and dynamic way. With my articulation of the assumptions of goal setting, I hope to contribute to the self-reflection of rehabilitation practitioners as well as to theoretical discussions of goal setting in contexts other than rehabilitation. Donald Lee has claimed that of three ethical values, freedom, justice, and security-survival, involved in the effects of population growth on the future and the survival of all human beings, security-survival is the most fundamental. As such, it should have priority over freedom and justice. Based on this hierarchy, Lee draws the conclusion that one does not have the right to unlimited procreation, and that ultimately it is the duty of government to impose limits on population growth. I accept Lee’s (...) argument that personal rights must be balanced by personal responsibility, but I argue that justice is the fundamental ethical principle in this discussion. This is not a trivial distinction, for it leads to two significant conclusions. First, by focusing proper attention on justice, the threat to survival of the race from overpopulation is reduced to reasonable and realistic proportions. Second, and particulady important with regard to Lee’s position, the recognition of the need for justice brings to light the fact that the primary responsibility of government is to address itself to redressing injustice in society, injustice which does pose a very real threat to the survival of mankind. In this context, I argue that under no circumstances should government have the right or the responsibility to enforce limits on procreation. (shrink)

In the last decades of the twentieth century nature writing lost some of its enchantment with the idea of wilderness. It was criticized for its remoteness, separating the natural world from human life, for being out of step with the interests of Indigenous peoples, and for holding an otherwise dynamic natural world, static. Recently, however, writers have begun to rehabilitate the idea of wilderness, and call for increased wilderness conservation. The period of critique was helpful in clarifying both the nature (...) and need for wilderness conservation, as well as for other stewardship practices. I trace some of the disagreements, particularly between the traditional conservationist and those advocating bolder stewardship practices that do not so much conserve the natural world as they remake it. I doubt that we either do or must live in an exclusively post-wild engineered world, and find a place also for natural heritage and its conservation. (shrink)

Concern is growing as research continues to find evidence of academic misconduct among medical students. There is, however, paucity of information on this issue among medical students and medical graduates in Africa. We determined the perceptions and attitude of house officers on academic misconduct within Nigerian medical schools. We conducted 7 focus group discussions among pre-registration house-officers working in a Nigerian Teaching hospital between October and November 2013. A FGD guide containing 7 broad questions related to their perception and attitude (...) on academic misconduct was employed. Ethnographic content analysis and manual coding were adopted in identifying themes, issues and representative quotations. A total of 58 participants out of an eligible pool of 76 PRHOs were recruited. All the groups associated academic misconduct chiefly with cheating in examinations, and perceived it as a commonplace problem. “It is a part of school life”, admitted one PRHO. Copying during exam appeared to be the commonest form of cheating. Another respondent opined that “The lecturers should be more concerned with helping students understand better. They should not make passing an exam a do-or-die affair.” The perception and attitudes towards academic misconduct may be a reflection of the prevailing moral decline in the contemporary Nigerian society. Underlying the reasons adduced by the participants for getting involved in academic misconduct is the fear of failure in examinations. Apart from consolidating formal and informal medical ethics education, the medical schools should ensure that the opportunities and pressures to indulge in academic misconduct are minimized. In contemporary liberal ethics patient autonomy is often interpreted as the right to self-determination: when it comes to treatment decisions, the patient is given the right to give or withhold informed consent. This paper joins in the philosophical and ethical criticism of the liberal interpretation as it does not regard patient autonomy as a right, rule or principle, but rather as a practice. Patient autonomy, or so I will argue, is realised in the concrete activities of day-to-day health care, in (...) the material and technological context of care, in arrangements of health care institutions, in the physical training of people with disabilities, as well as in the concrete activities of care-giving. This move from conversations in the consultation room to other sites and situations in the practice of care takes seriously the empirical reality of medical care and intends to show that patient autonomy is practically realised in a much richer and more creative way than most ethical theory seems to assume. About 2 million minor children in the U.S. have at least one parent incarcerated for criminal offenses. There are about 33,000 undocumented persons detained by Immigration and Customs Enforcement in jails and federal detention centers around the country, and 79% of the minor children of these detainees are U.S. citizens. There are few government programs that measure and respond to the harm caused to these children by the incarceration and detention of their parents, and the negative effects on these children (...) are largely ignored in public policy debates about incarceration and immigration detention. I argue that we have an obligation to these children based on the special status of children, the harm caused to children by the arrest, detention and incarceration of their parents, current incarceration and detention policies even in the presence of alternatives that would, on balance, create less harm. In this paper, I survey liberal and communitarian defenses of privacy, paying particular attention to defenses of privacy in the workplace. I argue that liberalism cannot explain all our of intuitions about the wrongness of workplace invasions of privacy. Communitarianism, on the other hand, is able to account for these intuitions.

The climate change mitigation effort is being translated into several actions and discourses that make collateral benefits and their rationale increasingly relevant for sustainability, in such a way that they are now a constant part of the political agenda. Taking a broader and consensual perspective, co-benefits are considered here to be emerging advantages of implementing measures to lower greenhouse gases. Starting with the analysis of policy documents referring to two European urban transportation strategies, the emergent co-benefits are problematized and discussed (...) to better understand their moral aspect. Further ethical reflection is conducted after an analysis of some unintended consequences of the co-benefits rationale arising from the examples. The discussion focuses primarily on the challenges of an integrative moral justification for co-benefits and also for their role in the climate change mitigation effort. We also discuss the limitations of the current normative models that frame a co-benefits rationale, both from a moral viewpoint and in relation to the overall climate change mitigation strategy. In this article, we propose the concepts of well-being and freedom, as portrayed by the Capability Approach, as possible guiding notions for the moral and social evaluation of goodness of these emergent benefits as well as their rationale. Additionally, some preliminary conclusions are drawn regarding the potential of the presented concepts to support climate change mitigation action. Finally, we outline a scenario where the Capability Approach is the moral guideline for a co-benefits rationale and illustrates its potential in terms of enhancing climate change mitigation strategy. Good academic practice is more than the avoidance of clear-cut cheating. It also involves navigation of the gray zones between cheating and good practice. The existing literature has left students’ understanding of gray zone practices largely unexplored. To begin filling in this gap, we present results from a questionnaire study involving N = 1639 undergraduate students from seven European countries representing all major disciplines. We show that large numbers of these students are unable to identify gray area issues and lack (...) sensitivity to the context dependence of these. We also show that a considerable proportion of students have a poor understanding of concepts like plagiarism and falsification, not only in gray zone scenarios, but also in cases of relatively clear-cut cheating. Our results are similar across the faculties and countries of study, and even for students who have attended academic integrity training. Allen Carlson has argued that a science-based model of appreciation is most appropriate in the aesthetic appreciation of nature. While I find his model of appreciation coherent and valuable, I reject his argument that this model ought to be preferred to others, such as an emotion-based or a formalist model of appreciation. Carlson's rejection of these other models is exclusionary and runs counter to pragmatist ideals. I argue for an alternative model, one which accommodates both cognitive and noncognitive models of (...) appreciation, which I call the aesthetic-attention model of appreciation. (shrink)

Since Stalbaum’s 1838 translation revived interest in Plato’s Timaeus, commentators have tended to bracket the discourse on Necessity, reading it as either mythical or mystical. This essay offers an interpretation of Necessity that is also an assertion of its importance for understanding the philosophically important conception of chora-space found therein. Beginning with throwing ourselves back into the Presocratic milieu, I examine what remains of Presocratic notions of kreon and ananke (necessity) in order to move forward a more robust interpretation of (...) the discourse on Necessity and chora-space. The life and work of Rousseau the musician and aesthetician has been largely neglected in the debate about Rousseau's views on women. In this paper, I shall introduce a new text and a new female figure into the conversation: Collette, the shepherdess in Le devin du village, an opera written by Rousseau in 1752. We see an ambiguity in Collette-the text often expresses one view while the music expresses another. When we take Collette's music seriously the following picture emerges: the (...) natural desire of women to be free, a fairly active female agency, an incipient rebellion against the social role of women, and a final acceptance of the role of wife. This view of Collette supports the thesis that for Rousseau women are not naturally subordinate to men but are taught to be subordinate because it is required for the maintenance of the patriarchal family, the cornerstone of civil society. We see many glimpses of Collette's true, unsocialized, nature, especially in the melodies she sings. It is in song, the first and hence most natural language of humans, that we see Collette's longing for freedom. But she ends by singing the praises of civil society, albeit a rural society, and thus implicitly accepting the subordination she is destined to suffer at Colin's hands. (shrink)

The aim of my article is to relate Roberto Esposito’s reflections on Europe to his more recent proposal of instituent thought. I will try to do so by focusing on three theoretical cornerstones of Esposito’s thought: the first concerns the evidence of a link between Europe, philosophy and politics. The second is deconstructive: it highlights the inadequacy of the answers of the most important contemporary ontological-political paradigms to the European crisis, as well as the impossibility of interpreting this crisis through (...) theoretical-political categories such as sovereignty. The third relates more directly to the proposal of a new political ontology, which Esposito defines as instituent thought. Esposito’s discussion of political theology is the central theoretical nucleus of this study. This discussion will focus, in particular, on the category of negation, from which any political ontology that is based on pure affirmativeness or absolute negation is criticized. In his opinion, philosophical theories developed on the basis of these assumptions have proved to be incomplete or ineffective in relation to the current European and global philosophical and political crisis. Esposito therefore perceives the urgent need to propose a line of thought that is neither negatively destituent, nor affirmatively constituent, but instituent, capable of thinking about order through conflict. Provided that we do not think of the institution statically–in a conservative sense–but dynamically, as constant instituting in which conflict can become an instrument of a politics increasingly inspired by justice. Abstract:Life-writing combines, collates, or colludes many lives into one text. No work of fiction, biography, poetry, drama, memoir, journaling, blogging, or autobiography—all of them life-writing—does not do this, either blatantly or surreptitiously. I am interested in forms in which authors do not own up to writing about themselves under the cover of writing about another. This essay will focus on the implications of this generic collusion in writing in health care. Health care professionals are given space within their professional journals (...) to write personal essays about their work. Typically, these essays include a patient portrait or vignette as a means to probe some aspect of clinical practice. Some, not all, of these journals provide guidelines for protecting the privacy/confidentiality of patients described in the essay, including instructions for how to “fictionalize” patients or families to render them non-identifiable, even to themselves. A clinician-author may adopt this genre to illuminate a moment in practice that bears reflection and provides insight into the world of care. Often, however, the essay’s tenor is the author, and the patient is pressed into service as but the vehicle for that examination. The genre may be adopted to confess an error, to lament a woe (generalizable to all readers), to critique the actions of colleagues or patients, or to boast of a successful clinical intervention. Perhaps these essays are all, or should all, be co-authored “duets” by patient and clinician. (shrink)

One of the blessings of the academic life is sharing deep interests and concerns with one's colleagues, and I certainly have experienced that blessing. In person, I decided to respond to each person in the order in which they entered my life and I will also follow that format in these written comments.Nancy Auer FalkThe first person in this group whom I encountered was Nancy Falk, though, as she said, she doesn't remember me from those very early days. I entered the University of Chicago Divinity School in 1965, and because there were so few of us in those days, I clearly noticed a woman who was finishing her work in the same field I was entering—the history of religions. There were twelve women among some four hundred students at the Divinity School and six of us had entered that year! I remember that the professors were very worried about what to do with "all these women who now want to study religion." One of my professors said that he was changing some of the material he lectured on because of the presence of women in his class.In such an environment, I should have known better than to do a dissertation [End Page 89] studying women in religion and using feminist methodologies, which had not yet been developed, but which I did develop in my dissertation! It has taken me a long time to learn that telling the truth can exact a heavy price. I've often commented that all I've ever tried to do in my scholarship and in my thinking is to tell the truth. It's been hard to understand how that could be so controversial or so resented by so many people. But my dissertation was very controversial even though Mircea Eliade, who was still revered in those days, encouraged me to write the dissertation I did. But what I was doing was so controversial, largely I think, because I claimed that the sacrosanct University of Chicago methodology in the history of religions was inadequate, given that it simply had no tools with which to study the religious lives of at least half of humanity. Even years later I heard via some gossip train that students of the professor who most opposed my work were telling people that I was not supposed to have gotten a degree, but somehow, it had slipped though anyway. Now, some thirty-five years later, I am amazed at the level of insight I had as a graduate student in my mid to late twenties.During these graduate school battles, Nancy was already teaching at Western Michigan University, so I did not have her as an ally. But, as soon as I finished my degree, as she narrates in her comments, we began to work together on Unspoken Worlds, which, having been put together before computers, was extremely labor intensive. How might the idea of recognition offer a fresh slant on contemporary women’s writing? In this essay, we bring theories of recognition into dialogue with two literary works: Chris Kraus’s widely reviewed memoir I Love Dick and The Other Woman by the well-regarded Swedish novelist Therese Bohman. Our analysis focuses on recognition within the texts as well as its relevance to relations between texts and readers. We seek to clarify how attitudes to heterosexual love, feminism and same-sex identification are entangled (...) and the broader implications of such entanglements. We are interested in how the protagonists engage the world as readers and the role of literature in shaping their identifications and attachments. Yet, a comparative analysis can also bring to light how a feminist habitus is predicated on class and education, suggesting that these two texts may invite rather different experiences of recognition. I The area between sensation and conceptualization is gray and confusing. Despite abundant philosophical and empirical research, results about how to understand this area that command widespread assent are very scarce. One contributory source to this impasse is the fact that, for mature and intact humans, the sensory, the perceptual, and the conceptual seem merged in consciousness. Perception is phenomenally so "cognitively penetrable" - so infused for humans by discursive understanding - that experimental and theoretical efforts to distinguish between it (...) and conceptualization, and consequently between it and sensation, often seem constrained only by whatever favored theory drives the effort. In what follows, I consider reasons for distin- guishing perceptual from conceptual categories and suggest a way of making the distinction. I applaud Mitchell et al.’s expanded emphasis on cognition in learning theory, for our understanding pervades all we do. Nevertheless, there are fundamental problems with the propositional approach they propose. The title bills a propositional approach to human associative learning, animal learning being tucked in later as an egalitarian gesture, but the model proposed would be a standard neo-classic account of human learning in terms of a representational theory of mind /except for /its universal extension to all learning, human and (...) otherwise. Such neo-classic accounts deem it explanation enough of some human behavior to hypothesize rich formal structures of inference and sentence generation internal to the organism as causes of like changes in behavior. The hypothesized structures are extrapolated from formal linguistics and formal logic. Some have found such explanations useful, not surprisingly for computer modeling of human linguistic behavior, but the target article’s bold step is to extend the neo-classic model to all animal learning. The orgasm gap is the marked difference in the frequency of orgasm between cisgender men and women in heterosexual intercourse that has been documented in research for decades. However, orgasm as a state of intense sexual excitement and gratification is physiologically uncomplicated and readily available for most people regardless of gender. This article undertakes a philosophical study of the processes by which the individual experience of orgasm is invested with meaning and embedded in social and cultural practices that collectively both (...) produce and sustain the orgasm gap. By looking at the experience of orgasm as horizonal, I draw a distinction between the social and the cultural horizons of sexual experiences. I argue that social standards of sexual modesty make sexuality a field where the process through which we make sense of our individual experiences is especially dependent on how these experiences are depicted in cultural representation. The current socially normalised male perspective in cultural representation continues to conflict with the ways orgasm is experienced in female bodies. This is probably one reason why the orgasm gap persists even in countries where sex education and gender equality are highly advanced. (shrink)

The past 20–30 years have provided plenty of new empirical data on women’s sexuality, a topic often theorised as puzzling and unexplainable. In recent discussions, a controversial issue has been the phenomenon of sexual concordance, i.e. the correlation between the self-reported, subjective assessment of one’s sexual arousal and the simultaneous bodily response measured directly on the genitals. In laboratory-based assessments, sexual concordance has been observed to be on average substantially lower in women than in men, although the reasons for the (...) considerable gender difference are still open to debate. Drawing on a phenomenological approach to culture-dependent meaning-formation and on feminist social theory of everyday sexuality, I argue that the reasons behind women’s low sexual concordance can be found neither in their minds nor their bodies but in the way meaning-making processes function in human sexual experiences. Women’s first-person perspectives on their own sexuality have historically played only a marginal role in the creation of socially endorsed sexual meanings, yet these shared meanings have a profound influence on how individuals make sense of their bodily experiences in sexual situations. This study examines the ways in which gendered definitions of social provision in Costa Rica have created gaps in national health care programs that women's organizations are currently addressing. More specifically, I highlight how women's organizations are key actors in the politics of needs interpretation, wherein definitions of health needs are contested by policy makers, doctors, and women themselves. I argue that women's health organizations have begun to broaden and politicize health needs by including domestic violence in national debates. Using (...) interviews and organizational histories of six grassroots health organizations, I find that these groups have been successful, in large part, because they framed their concerns in ways that were convincing to politicians and national health care bureaucrats. Although the work of Revonsuo is commendable for its attempt to use an evolutionary approach to formulate a hypothesis about the adaptive function of dreaming, the conclusions arrived at by this author cannot be fully shared. Particularly questionable is the idea that the specific function of dreaming is to simulate threatening events. I propose here a hypothesis in which the dream can have a different function. [Revonsuo].

The individual motorist often defends his unwillingness to change his driving habits in the face of air pollution by pointing out that a change in his actions would be insignificant. The environmentalist responds by asking what would happen if everyone did change. In this paper I defend the environmentalist’s response. I argue that we can appeal to the following principle to defend both group and individual obligations to clean up air: if the consequences of everyone doing aare undesirable, then each (...) and every one ought to do was he can to prevent the undesirable consequences. In this paper, I investigate the German N hin, N her construction. I first provide a close description of its syntactic and semantic properties, arguing that N hin, N her is a grammatical construction. I then show that this construction is not entirely idiosyncratic, as there are specific pragmatic aspects contributing to its meaning and functional potential. I argue that a purely (...) semantic analysis of the construction as concessive or concessive conditional is insufficient, as it neglects pragmatic processes of contextual enrichment and implicature. Based on these assumptions, I provide a detailed analysis of the discursive and interactional functions of the construction, showing that it is a prime candidate for construing textual coherence and for subjectification and stance taking. The individual motorist often defends his unwillingness to change his driving habits in the face of air pollution by pointing out that a change in his actions would be insignificant. The environmentalist responds by asking what would happen if everyone did change. In this paper I defend the environmentalist’s response. I argue that we can appeal to the following principle to defend both group and individual obligations to clean up air: if the consequences of everyone doing aare undesirable, then each (...) and every one ought to do was he can to prevent the undesirable consequences. Care ethics can provide a valuable conceptual and normative resource for many issues in law, but given the conservative nature of law in general, much work needs to be done before care ethics can explicitly play such a role. In this paper I survey the landscape of law, discuss two attempts to incorporate care ethics into the normative framework of law, and suggest other avenues for incorporating care ethics in law and legal reasoning.

: The life and work of Rousseau the musician and aesthetician has been largely neglected in the debate about Rousseau's views on women. In this paper, I shall introduce a new text and a new female figure into the conversation: Collette, the shepherdess in Le devin du village, an opera written by Rousseau in 1752. We see an ambiguity in Collette--the text often expresses one view while the music expresses another. When we take Collette's music seriously the following picture emerges: (...) the natural desire of women to be free, a fairly active female agency, an incipient rebellion against the social role of women, and a final acceptance of the role of wife. This view of Collette supports the thesis that for Rousseau women are not naturally subordinate to men but are taught to be subordinate because it is required for the maintenance of the patriarchal family, the cornerstone of civil society. We see many glimpses of Collette's true, unsocialized, nature, especially in the melodies she sings. It is in song, the first and hence most natural language of humans, that we see Collette's longing for freedom. But she ends by singing the praises of civil society, albeit a rural society, and thus implicitly accepting the subordination she is destined to suffer at Colin's hands. (shrink)

The right to be secure from torture, a right that encompasses moral as well as legal strictures against the practice, is supported by increasingly stringent human rights instruments. In this essay, I have discussed the principal instruments and their place in the anti-torture field considered broadly. The phenomenon of these international instruments foreshadows an ever-widening range of legal initiatives against torture, and is emblematic of the increasing importance attached to respect for human life and human dignity. The diversity of international (...) treaties providing against torture such as, for example, The Convention on the Prevention and Punishment of the Crime of Genocide (1948), The Supplementary Convention on the Abolition of Slavery (1956), The International Convention on the Elimination of All Forms of Racial Discrimination (1965), and The International Convention on the Suppression and Punishment of the Crime of Apartheid (1973), indicates the interconnectedness of a wide range of human rights issues.The boundaries that have been drawn around the violation constituted by torture are clearer at present than are those bounding many other rights. Rights commonly categorized as of an economic nature - the right to food and to development, for example - are undergoing processes of definition and implementation. One challenge of this paper is to generate procedures presently attached to such specific human rights violations as torture to rights with less clear parameters. In this way, the growing effectiveness of procedures against torture can serve in the long term to strengthen the bases of international human rights law while in the short term helping to expand the armory of procedures for the protection of less clearly-defined, rights. International human rights law offers a practical tool towards eliminating torture from states' instruments for governing and provides a model for the development of procedures in other categories of rights, while bringing universally declared moral aspirations and legal authority into closer alignment. Specifically, the question is, "How do I understand my own identity as a religious Buddhist or Christian in light of the fact that I am open to the validity of the beliefs held (...) by the other tradition?"Frankly, this puzzle seems like a no-brainer to me and always has. Religions are language systems, and no language is universal and absolute. End of problem. In one fell swoop, as we concede the relativity of all our language games, we also recognize that more than one language could be "valid," whatever that might mean. There is no reason to assume that all people speak my language and it would be illogical to claim that people who don't speak my language are deficient. The worth and utility of my language is in no way diminished because it is not the only language in the world. Language is a tool through which we communicate, and any language could be a useful tool, so long as we don't endow it with universal relevance, more freight than it can bear.There may or may not be a formless absolute that grounds all finite existence. All religions assert that there is, whether as a being or as an experience. But beyond that assertion nothing can be determined because all such assertions must be expressed in language or some other limited expression—an expression in form. There is no other option. Much as we might long to transcend expression in form and leap into mind-to-mind transmission, in a public medium that is not possible. Many of us may have intuited such experiences of mind-to-mind transmission, but when we open our mouths to speak, we can only do so in the realm of form. And so we are stuck with our myriad expressions of a formless, transcendent absolute and cannot even determine for sure if we are talking about the same thing when we try to express the inexpressible.Therefore, we are compelled to concede the limits of language. This is the solution to the problem of the coexistence of a strong individual religious identity with openness to the relevance of other religious languages. Other religions, as well as my [End Page 15] own, are nothing more than highly relative language systems. There is no logical or spiritual way for them to be anything more. It seems to me that copping to the limitations of language, to the inability of language ever to capture truth completely, is completely essential in the pluralistic world we now inhabit. It is hard to imagine how people could believe that the deity speaks Arabic, not Hebrew, or Hebrew, not Arabic, and biblical Hebrew (rather than any other version of Hebrew) at that! It is hard to imagine how people could believe that they have the actual words of Jesus in the red print in their new testaments, even though those words were originally written in a language he never spoke and were translated into an archaic English that we no longer speak and barely understand. Nothing but egotistical pride can drive such self-aggrandizement, such identification of my viewpoint, my verbal attempts to express my experience, with the eternal and ultimate Way Things Are.In light of the historical and cross-cultural information that is now more than abundantly available, the only rational and humane conclusion to be drawn is that all religious institutions and creedal systems are human constructions dependent at least in part, if not wholly dependent, on the particular circumstances of those who construct and utter them. Therefore, they are of limited rather than universal relevance. Their cultural specificity is too obvious for any other conclusion to be feasible. Arabic, Hebrew, Greek, and English are not universal languages, and only extreme hubris could claim the Formless Absolute speaks my language, not yours. The theoretical model of landscape that is still widespread is that of a spectacle-image that offers itself to a contemplative, detached and disembodied gaze. Rethinking landscape means investigating the role of the “aesthetic”, i.e. of bodily experience, characterized by sensitivity and movement. This experience, which is fundamentally interactive, has a formative and performative nature: the aisthesis is closely linked to praxis, to the concrete ways in which we re-late to the environment and which become interactive strategies. These strategies can become (...) experiential habits that, if repeated in a mechanical way, can jeopardize the very interaction with the phenomenal world in which we are immersed. We tend to grasp only certain aspects of the phenomena that present themselves to us, over-looking not only the richness and plurality of the phenomenal world, but also its fundamental systemic and relational unity. The possibilities of formative and performative interaction can be grasped if the ordinary and daily level of experience is chal-lenged by sudden and unexpected encounters, which can initially provoke a sense of bewilderment and disorientation. What becomes “present” is the rhythmic unity of the phenomenal world, understood as an energetic momentum that holds together in a dynamic way the different elements of the world we inhabit. Through the con-cept of rhythm elaborated by Henri Maldiney we could advance a new aesthetic model of landscape understood as an actual cosmogenesis. (shrink)

In this article, I reflect on Benedict Anderson’s work on Indonesian urbanism. There are at least three concepts from Anderson’s work, particularly Imagined Communities, which deserve further attention in Indonesia’s urban studies, namely: 1) political cultures; 2) territorial boundaries; and 3) the urban scale of imagined communities. Besides the conceptual dimensions, the perspectives of Anderson’s work that featured ethical stance and strong commitments are useful principles in studying urbanisms in Indonesia, particularly in dealing with pragmatism in urban development. The three (...) conceptual dimensions, along with the critical stance toward political and economic elites, point towards paying increased attention to marginalized communities in conducting urban research. Gross University of Wisconsin-Eau Claire Many studies have indicated that at both ends of the life cycle human beings more readily survive and flourish if they experience significant contact with other humans, if they experience nurturing, love, and relationship. Having physical needs met, by itself, is not sufficient. Both infants and (...) old people, as well as people recovering from serious illness, are much more likely to survive if, in addition to having their physical needs met, they experience the emotional well-being brought about by sufficient companionship.Though the issue is less discussed, one wonders why things would be different in those phases of the life cycle in which one is seemingly more independent. How can adults flourish and thrive without sufficient companionship, love, and community? How do adults react to the absence of these important elements of life? I would suggest that relatively helpless infants, invalids, and aged people simply die, but adults have enough power and independence to react to their loneliness and frustration in ways that lash out at the social fabric that fails to love and nurture them sufficiently. In Buddhist psychology an organism's two most frequent reactions to stimulation are grasping at something or aggression toward it. I would suggest that unnurtured adults express their frustration with loneliness and lack of love precisely in those two ways. We have discussed these reactions in our previous sessions on war and on consumerism and its attendant environmental degradation.I agreed very reluctantly to write a paper for this session on community. I am reluctant for two reasons. First, I have already written on community, do not wish to repeat myself, and am not sure I have anything new to say. Thus, I end up with the option of being more personal in my reflections than I usually am. (I know some of you will think that could not be possible, because I always go too far on that score. My apologies.) Second, as a female academic and someone with no family who has been single most of my life, I know only too well the loneliness and frustration that come with living in a society with declining "social capital," to use the phrase so aptly employed by Robert Putnam in his book Bowling Alone. The topic is simply too painful for me, because I know intimately, by virtue of their absence in my life, the importance of companionship, friendship, and community. I appreciated all the [End Page 3] graphs and documentation in Putnam's book, but despite my many years of intense involvement in the Buddhist world, I already knew in my gut the main thesis of his book. Nevertheless, much of what I will write about in this paper is informed by Putnam's book, as well as by David Korten's The Post-Corporate World and bell hooks's All About Love, both of which I recommend as relevant reading materials as we prepare to discuss the topic of community.By contrast, for our first discussions of community in our 1987 meetings, I was eager to make a contribution. 1 I had discovered something, or so it seemed to me, that was both painful and important. In the early 1980s I began to realize that despite the energy and loyalty I brought to my Buddhist community, I was still lonely and was not experiencing the friendship, community, companionship, and support that seemed to me to be implied in the act of "going for refuge to the sangha. " Instead, people constantly told me that being alone was essential to Buddhist practice—a claim that I would contend has more to do withWestern notions of individualism and self-reliance than with Buddhism. Understandably, these values are especially strong among convert Buddhists, who had to defy convention and assert their individuality in the process of becoming Buddhists. Setting the context for these issues are an introduction, (...) a chapter on how Engaged Buddhist social ethics is built from Buddhist tradition, and another surveying Engaged Buddhist [End Page 174] ethical theory. The author's conclusions and evaluations of the movement, for the most part, are found in the last chapter, the book's eighth.In her preface, King explains a crucial decision she made regarding the extent of her analysis of Engaged Buddhism. She realized that an important question about Engaged Buddhism concerns its relationship with Western thought and decided that she could better focus on that question and "avoid muddying the waters" (p. xii) by not including Western Engaged Buddhist thinking in her survey. She further justifies this decision by claiming that Western Buddhists are still largely students of Asian Buddhists who need to overcome familiar cultural habits "to clearly perceive the otherness of Buddhism and what it has to offer" (p. xii). This decision makes sense in its own context, and I agree that many Western Buddhists seem to not understand that the spiritual and philosophical foundations of Buddhism are quite different from those of Western religions. Unfortunately, the decision to not include Western Engaged Buddhists also furthers a view that Buddhism is "foreign," and, therefore, not directly relevant to Westerners or to the issues that most occupy Westerners in our day. Many Western Buddhists are at pains to undercut precisely that view of Buddhism. However, I do concede that including Western Engaged Buddhists in her analysis would have complicated her task enormously.King's concerns about the relationship between Engaged Buddhist thinking and Western thinking have more to do with refuting the claim made by "traditional" Buddhists, both Asian and Western, that the Engaged Buddhist movement is merely the product of Western influences and, therefore, not truly Buddhist. She refutes this claim by demonstrating that the most influential Asian Engaged Buddhist leaders are intelligent, well-educated people who are unlikely to meekly adopt foreign ideas. Cogently, she argues that Western influences on Engaged Buddhism do not make Engaged Buddhism "the product of Western influences" and that the claim that Engaged Buddhism is the result of Western cultural imperialism denies what it is trying to protect: "the subjectivity and agency of the Engaged Buddhist leaders themselves" (p. 3). She demonstrates that Asian Engaged Buddhist leaders are selective about which Western concepts they include in their discussions of social ethics and that their thinking about social ethics has deep consonance with utterly basic Buddhist concerns, such as interdependence, the Four Noble Truths, anatman (lack of independent abiding self), the enlightenability of human beings, the importance of compassion, the importance of varied self-transformative practices, and nonviolence.Before delving into Engaged Buddhism's major concerns in depth, King provides a lengthy chapter in which she outlines Engaged Buddhist ethical theory. She does not claim that Engaged Buddhists have worked out a systematic ethical philosophy, but rather that certain ideas and claims underlie their recommendations and actions, although not all of them are used by every Engaged Buddhist or in every situation. Natural law ethics, which claims that ethical requirements are not culturally relative because they stem from the nature of reality itself, not human invention, is an important element in Engaged Buddhist thinking, she [End Page 175] claims. Engaged Buddhists also use a developmental perspective, recognizing that, as individuals develop, ethical understanding also develops. They are also especially timely and important, given how much goddesses and the divine feminine have been [End Page 175] overlooked and ignored by those involved in Buddhist-Christian interchange and comparative studies as well as by serious scholars of both traditions.These books will function mainly as goldmines of information about goddesses in Buddhist and Western religions rather than as theoretical and theological analyses about what is at stake in the presence or absence of goddesses and imagery of the divine feminine in either tradition. As is well known, imagery of the divine feminine is longstanding and of considerable importance in Buddhist traditions, even though it was not part of the earliest layers of Buddhist traditions, whereas the divine feminine is largely absent in more recent Western traditions, even though it was common in the ancient Near East. Thus, these two traditions are mirror images of each other’s historical development concerning the divine feminine. It would be fascinating to explore this difference between the traditions. Because neither book is comparative in any way, such questions are not entertained in these books, but at least both books provide a great deal of information that others may use in future explorations of such similarities and differences between the traditions.Most of Miranda Shaw’s analytical comments are found in her brief, thirteen-page introduction. The rest of the book is mainly descriptive. Most of this discussion concerns her choice of the term “goddess” to refer to the many nonhuman, divine females found in Buddhist art and literature. She notes that, while mention of Goddesses is widespread and long-term in works on Buddhist art and history, Buddhist studies in general has not paid much attention to goddesses, and the same basic information has been repeated over and over, with few advances in interpreting and understanding these figures. I would agree with this assessment. She also notes, correctly, that Buddhist goddesses have received scant attention in the recent spate of Western scholarly investigations of goddesses and the divine feminine. Nevertheless, as Shaw points out, various kinds of divine females occupy every niche of the divine hierarchy in Indian and Buddhist cosmology. Indeed, it would be impossible to look at any book about Indian Buddhist art without noticing many voluptuous, highly attractive female figures as well as some more fearsome figures.Shaw justifies her use of the term “goddess” by noting that this is the literal translation of the term routinely used for female divine figures in Indian Buddhist sources. This justification is pointed at several other scholars who have written about Buddhist “goddesses” from a Buddhist point of view but who have avoided the term “goddess” for various reasons, but mainly because of the complexity and explosiveness of that term in Western contexts. The term has also been avoided by Western Buddhist scholars because of possible misunderstandings or confusion that could be caused by the use of such a theistic term in the context of non-theistic Buddhism. Nevertheless, Shaw is correct that the common translation of the terms used in Buddhist texts would be “goddess.” In her discussion of the term “goddess,” Shaw also justifies this English terminology by arguing that the “deities,” especially of Vajrayana Buddhism, are not merely symbols created by human beings or projections of human experiences but have another, transhuman reality. The metaphysics of “deities” or “goddesses” in Buddhism is, however, an extremely complex and subtle matter that cannot be adequately discussed in the few pages Shaw devotes to this issue. Part of Young's innovation is her use of Buddhist art and iconography, which she takes as seriously as textual sources are usually taken in Buddhist studies. Many of her most interesting suggestions and conclusions result from the seriousness with which she takes Buddhist art as resource for understanding Buddhism more accurately and completely. The other foci are clear from her subtitle: narrative and ritual. There is much less attention to the canonical and philosophical texts of Buddhism that are so often invoked in studies of Buddhism and gender.Studies of sexuality or gender often end up primarily discussing new information about women and new ways of understanding women's participation in or exclusion from religion. This study is no exception, which is not in any way to fault the book. Young's analyses center on ways that women have been both included in the Buddhist world and excluded from that world. Among the many varieties of Buddhism, Young primarily focuses on early Indian Buddhism and Tantric Buddhism, which have the most provocative teachings about gender and sexuality. In Young's analyses, we see how women participated in early Buddhism in ways that have not been recognized in most earlier scholarship and ways in which they are excluded from Tantric Buddhism and most later forms of Buddhism that have not always been acknowledged.Young's interpretations of the traditional life stories of the Buddha are extremely innovative and interesting. She argues that the future Buddha's rejection of women when he left his home and family must be balanced with his reintegration into the world of women before and during his enlightenment experience. She argues that this reintegration is evidenced especially in his acceptance of food from Sujata and in the help he received from the Earth Goddess during his trials with Mara. Young argues that many Buddhists throughout the ages have focused on episodes in his life that deal with rejection of women but have not fully taken in the implications of the stories in which women become important allies in the mission of the Buddha.The sources for early Indian Buddhism most invoked by Western scholars of Buddhism are textual. These textual sources present a very mixed picture of women's lot in early Indian Buddhism. On the one hand, the Therigatha and some stories from the life of the Buddha present a relatively optimistic picture of women's possibilities and their acceptance in the early Buddhist community. On the other hand, texts present a constant message of the importance of renunciation, and much of the recommended renunciation involves women. Texts written by and for monks frequently conflate women with sexuality and hold women responsible for wayward monks' sexual temptations. Against this widely known material, Young calls upon the evidence of early Indian Buddhist art to argue that the monks' anti-women texts [End Page 174] do not tell the whole story about women in early Indian Buddhism. The art work, which was much more important for tutoring largely illiterate Buddhist laypeople, consistently portrays women voluptuously and positively. This contrast between text and art is so great that recently, during a slide show in a class I taught on ancient Indian Buddhism, a student asked point blank how monks could possibly sanction the voluptuous portrayals of women common in early Indian Buddhist sanctuaries. I didn't remember Young's cogent analysis at first, but eventually did reply, using her analysis. The monastic establishment controlled the discourse that eventually became the texts of early Buddhism, but the lay donors controlled the visual representations that decorated the sites where Buddhism was preserved.
